Construction Contractors’ Guide to Compliance with Buy American and Other Domestic Preference Requirements

President Trump ran on a platform of “Buy American, Hire American” so it is no surprise that strengthening domestic preference regulations is part of his administration’s agenda. What can come as a surprise to unsuspecting contractors is the complex and confusing regulatory framework implementing the current domestic preference requirements on government projects. This seminar will cover the scope of regulations such as Buy American, Buy America, and the Trade Agreements Act. Importantly, discussion will focus on compliance with these regulations and the possible consequences of accidental or intentional non-compliance.

About The Presenters

Owen S. Walker, Esq.
Smith Pachter McWhorter, PLC.
Mr. Walker focuses his practice on commercial construction and government contracts law. He represents contractors, subcontractors, owners, and design professionals in all phases of construction projects, from contract preparation and negotiation through dispute resolution and litigation. Mr. Walker counsels federal government contractors on a range of issues, including preparation of certified claims, bid protests and other procurement issues, internal investigations, and compliance with the Federal Acquisition Regulations and agency supplemental regulations. He is a regular speaker before a variety of industry groups and has authored numerous articles and book chapters on commercial construction and government contracts law.

Ms. Kopcienski practices in the areas of commercial construction, government contracts, and white collar matters. She has experience with litigation and alternative dispute resolution procedures, focusing on construction insurance and warranty issues, prime-subcontractor disputes, claim entitlement and liability, and electronic discovery. Additionally, she has counseled clients on bid protests, performance disputes, privilege, and federal agency procurement practices.
