Did you know that under DC, Maryland and Virginia law, upper tier subcontractors and prime contractors are potentially liable for the failure of their lower-tier subcontractor to properly pay and classify their workers? Under various laws, which started out of California, many jurisdictions have passed statutes that hold those in an upper tier contractual positions jointly and severally liable for wage theft and misclassification.
